FDA Announces E-Cigarette Regulations

FDA E-Cig RegulationsThe tobacco deeming regulations were announced this week by the federal government, after years of speculation as to how they would impact the electronic cigarettes industry. As the industry has long been unregulated, it was a continuous discussion that everyone knew wasn’t about if; it was about when. Well, that when is now, and if Congress doesn’t act to overturn these rules, there is the potential for the industry to be quite negatively as a result.

The most confounding aspect of these regulations is that the FDA is categorizing an entire industry’s worth of products that contain no tobacco, as tobacco products. This is done simply to adhere to the February 2007 “grandfather date” and does not account for the thousands of products that simply did not exist at that time. For companies that manufacture vapor products, being able to keep their products on the market will require lengthy paperwork for every product sold, with application costs that can reach as high as $1 million per application. Not many companies, outside of the massive few, and those owned by cigarette companies will be able to front this. And simply, this type of regulation, which targets a growing market is blatantly wrong.

These initial regulations are still being examined, and some rules are less concrete than others, at the moment. Some of the regulations that will go into effect 90 days from now include:

  • No free samples of vapor products can be distributed
  • No sales via vending machines
  • Age verification will be required for purchase, as no sales will be permitted to those under 18, whether online or in retail locations

However, other areas of the nearly 500 page text detailing the deeming regulations are less set in stone, and subject to Congress overturning them. It certainly goes without say, the entire vapor products industry as well as all the researchers involved in examining the benefits of e-cigarettes have been up in arms. There is an overwhelming amount of support for these products, and many feel the positives they possess far outweigh the few negatives.

Currently there is a lot going on as the vape Industry prepares to fight for our rights of equality and by no means is this the end. We have long been ready for these regulations, and we are urging our customers to sign this petition to make it clear to the White House, and to Congress how beneficial vapor products are, and how destructive this type of legislation can be.

Big Pharma Can’t Handle the E-Cig

electronic cigaretteWith the popularity of electronic cigarettes ever so steadily growing and outpacing traditional cigarette usage, it goes as no surprise that Big Pharma doesn’t know how to deal with the changing climate. Electronic cigarettes, and all products of this niche market are not cessation devices, they are considered to be alternative, smoke-free, tar-free, odorless options, however they are filling the void smokers have when faced with the conventional options. So is this really about the health of the general public and smokers, or is about the money?

Recently, a report came out, stating that Big Pharma was having a rather difficult time adjusting to the changes that have been occurring as a result of cigarette smokers taking it into their own hands on how to deal with their tobacco habits. Instead of going the route advocated by Big Pharma (aka the drug companies), and using their endorsed cessation aids by the likes of gums and nicotine patches, users have opted for the alternative in alternative cigarettes, and totally bypassing the actual cessation products. This breaking away from conventional wisdom and following the herd, doing as the drug companies tell you to do, is showing where the general public is at presently. People, smokers and otherwise, are not willing to blindly take advice any longer without their own investigating behind it. They are not so willing to just follow orders and do as they’re told without any knowledge on the subject.

They are willing however, to use common sense to make decisions for themselves. They are able to put 2-and-2 together, make conclusions, and experiment to find out what works for them. While they may be told a whole lot of rhetoric on electronic cigarettes not being regulated, not knowing what’s in them, and all sorts of other propaganda, the modern smoker knows how to read between the lines. They are willing to learn, and are not going to take every statement at face value.

So with this current speculation that the real antagonist isn’t actually Big Tobacco, and in reality, it’s Big Pharma, who spends more on lobbying than any other source, it’s wise for consumers and everyone in this industry to take a close look at how strings are getting pulled.

E-Cigarettes: Gateway to Smoke or Being Smoke Free?

While there were many occasions over the past few years where anti-smoking groups aimed to claim electronic cigarette and vaping products were not only unsafe, but going to lead to greater smoking numbers.

Not too long ago, one of the anti-smoking coalition’s loudest voices, Stanton Glantz, was reported in USA Today stating that “there’s no question that e-cigarettes are a gateway to smoking.” However, reality has proven otherwise.

If e-cigarettes were truly this gateway to a tobacco smoking frenzy, smoking numbers would be on the rise, not on the decline as they currently are. Yes, electronic cigarette numbers are up as expected, but there is no data or evidence to indicate that new smokers are starting with the digital variety and then moving towards tobacco. The reality is quite the contrary, and nonsmokers are really not getting on the e-cig trend at all. E-cigarettes appeal to current smokers who want alternatives to the traditional version.

Another factor proving e-cigarettes are trumping traditional tobacco cigarettes is that if e-cigs were really serving as a gateway, increasing tobacco usage figures would be on the rise, paralleling electronic cigarettes. Yet that is also not occurring, and adds to the argument that electronic cigarettes are not opening the doors to tobacco usage. There is no data on electronic cigarette users who have never used tobacco first, because these instances are few and far between. Less people are starting to smoke, and those who are current smokers are looking for other ways to enjoy nicotine.

Despite what the anti-electronic cigarette folks have to say, vaping is here to stay. They have not been able to convince the population or the regulators thus far as to their claims (which lack any scientific evidence), and sales figures do not lie: tobacco is on the decline, and vaping products are on the rise big time. In the US, teenage smoking numbers are the lowest they have been in decades, hitting record lows. This makes one fact clear: electronic cigarettes are not convincing American teens to start smoking, and tobacco is getting majorly upstaged.

 

Forbes Shines Spotlight on the Case for E-Cigarette Acceptance

E-CigAdvancedVaping-NOT-SmokingAn article that was just published in Forbes makes an excellent case on why the anti-smoking coalition should embrace, and endorse electronic cigarettes. Groups such as the American Lung Association and the American Cancer Society currently do not advocate for the use of the alternatives to tobacco cigarettes, and much of their information, unfortunately, can be traced to unreliable sources of distorted facts.

Recent statistics place current tobacco usage among American smokers at just 18% for adults, which is an all-time low. However, at the current rate of decline, it will take a whole 40 years to cut that figure in half, during which time, millions more will die of tobacco-related illnesses, per the predictions of Epidemiologists. Considering all the benefits of e-cigarettes, the fact that they contain no tobacco, and that there is no proof to any negative effects, their potential as an alternative for smokers has barely been tapped into so far.

One of the more common sense solutions that can be offered would be to make nicotine readily available. While electronic cigarettes are not legally able to be considered ‘cessation devices,’ or methods which users can quit smoking with, they certainly offer an option that gives users the ability to have the sensation they want without tobacco smoke and carcinogenic tar. In the “black and white” world of smoking and not smoking, e-cigs build bridges and accommodate, offering convenience and solutions.

Cigarettes Sales Decline as E-Cigs Profits Rise

As more smokers are turning to these alternatives that offer a smoke-free way of enjoying the same pleasure, (nicotine, sensation, and physical feeling included) the tobacco industry is really beginning to feel the effects. Millions of smokers have switched outright, and one in four have, at a minimum, tried an e-cigarette.

Phillip Morris International has been the first to put it out there that their profits for 2014 have been greatly lower than expected. Among the reasons for this is, it is obvious that electronic cigarettes are a major part of the fall.

Earnings have been severely impacted by sales declines in Europe, Asia and Australia as well as impending production cuts. In addition to these negative factors, Phillip Morris International has equated into their losses a $495 million fee that has come as a result of the planned shutting down of their production facility in the Netherlands at the end of this year. Their decision in closing it is a result of this cease in growth for their European market.

In addition to the sales declines, Phillip Morris shares recently fell much further than expected. The original prediction of full-year per-share earnings was expected to be between $5.09 and $5.19, however the newest reports  revealed that the actual number is much less than expected at a rate between $4.87 and $4.97.

The numbers don’t lie, both in terms of tobacco sales losses and electronic cigarette profits. As the e-cigarette industry continues to thrive and push towards the $2 billion-dollar sales mark this year, it’s evident that this industry will only continue to flourish.

Tobacco Companies Acknowledge Electronic Cigarettes

how-Electronic-cigarettes-workPhillip Morris International Inc. is the world’s largest publicly traded tobacco company. Responsible for many brands including being the manufacturer and seller of Marlboro cigarettes, even they are feeling the effects of electronic cigarettes hitting mainstream status.

Tobacco companies, particularly Phillip Morris International Inc., have begun to acknowledge the fact that tobacco cigarette sales are being impacted by the rise of electronic cigarettes as the population changes. While they are making note that fluctuations are inevitable, the international tobacco market is seeing an overall decrease due to the increase of alternative cigarettes. Users are simply moving away from tobacco, either quitting smoking outright, or switching to alternatives that offer more options and a less tainted image.

In addition to the lagging sales and the overall depreciation of profits, Phillip Morris is also factoring in a loss of $495 million that has come in the way of the impending closure of their production facility in the Netherlands. This is a result of the decreasing sales in their European market due to less people smoking. And it’s not just their European market where they are seeing a decline in sales, their Asian market has also reduced as well.

There is no getting around the fact that electronic cigarettes are not only becoming immensely popular everywhere but they’re having an incredibly overtaking effect on the traditional cigarette market considering they are sparking worldwide declines. It’s interesting that the largest tobacco companies are beginning to publicly recognize this, despite it being obvious for some time now.

Paralleling the declines of tobacco sales, Phillip Morris recently acquired Nicocigs LTD, an electronic cigarette company based in the UK. They are not the first tobacco company to do so, as Lorillard and Altria have already extended into this competitive market.

The bottom line here is that tobacco cigarette companies are fully aware that electric cigarettes are not going anywhere, and continue to expand at an exceedingly fast rate. Vapor is here to stay.

CVS Ditches Tobacco

6cc08baf-757c-49de-bb07-f55f75e86980It’s an obvious sign of the times when one of the largest national pharmacy chains announces they will no longer be carrying tobacco cigarettes and other tobacco products at any of their locations. It’s an even greater marker of the era we live in, when they push ahead with aforementioned plans prior to schedule. And this is exactly what CVS did this week.

As was announced earlier this year, CVS, the nation’s second largest drug store chain, made it known they intended to discontinue all sales of tobacco related items in the fall of 2014. In an effort to keep their products consistent with their “healthy” image, they felt carrying products known to cause cancer among other diseases was detrimental to their mission and reputation. They are a pharmacy after all.

This week however, CVS went ahead with these intentions, a month earlier than initially anticipated and from this point on, no longer carries tobacco cigarettes in any of their locations. Their new name, CVS Health (formerly CVS Caremark) is an additional step in this new direction.

CVS has no plans of advertising the new changes in their approximately 7,700 locations, although to those accustomed to grabbing a pack of smokes with their prescriptions, toiletries, and candy bars it will come as a huge change. Where their shelves at checkout counters were once filled with cigarettes, cigars, and related tobacco products, will now hold nicotine gums and signage encouraging smokers to drop the habit. While they are currently not retailers of e-cigarettes, it would be wise choice in the future to add tobacco alternatives to their nationwide selection.

The climate of drug stores has changed drastically over the years, and there is very much less of a “convenience store” atmosphere. It has been replaced with a more clinical setting and attitude. CVS offers so much more than just isles of random products and consumer-driven items such as cigarettes. Between their “Minute-Clinics” and health services such as providing flu shots, vaccinations, and diabetes monitoring; they have clearly achieved a very health-driven image.

This move is a very telling, indicative of the tobacco industry as a whole, and that the general public is becoming more health-conscious. We know this firsthand as e-cigarette sales have only expanded immensely! We applaud CVS’s bold move to distance their company from the shackles of tobacco, and do hope in the future they embrace electronic cigarettes for their many benefits and availabilities as tobacco and smoke-free products.

CVS Plans to Dropping Cigarettes

CVS-Pharmacy-01Recently, major retailer CVS Caremark announced that they will no longer be carrying tobacco cigarettes and products in any of their locations. In an effort to refine their image, and fulfill a more healthful outward appearance, the major national pharmacy chain stated that as of October 1, 2014, they will discontinue all sales of tobacco, making them the first major national chain pharmacy retailer to end their sales of tobacco.

Based on the revenue of prescriptions, CVS is the nation’s largest pharmacy. This move will affect all 7,600 CVS locations, and is expected to create a possible loss of $2 billion yearly. Despite this however, CVS is holding to their commitment. The single largest contributing factor that lead to this decision was the Affordable Care Act.

In our view, regardless of the financial toll, we applaud CVS for taking such a bold stand against tobacco. This move has been praised by both the American Medical Association as well as President Obama, a former smoker himself.

CVS has long maintained that prevention is the most effective health initiative, and the company believes that carrying tobacco products is not in line with their mission. CVS’ competitors, such as Walgreens, do not plan on discontinuing tobacco products, however interestingly enough, we believe that CVS should take a cue from companies such as Walgreens whose offerings include alternatives to tobacco, such as electronic cigarettes.

E-cigarettes are entirely different from traditional cigarettes, and Walgreens is among many major national chains to carry them. Providing an alternative option would benefit CVS immensely, and doing so could possibly help recover some of the sales they will be losing due to their ending of tobacco sales. As they are a pharmacy, the majority of their sales are not directly stemming from tobacco sales.

With the number of people smoking continuously on the decline, it only makes sense for retailers to expand in new directions, take new stands on products they do not agree with, and change with the times. As leaders in the electronic cigarette industry, we understand this need for change as well, and applaud CVS for standing up for the health of their customers.
